Clamp on Bulldozer Actions: Government Issues New Guidelines!

New Delhi: In light of the Supreme Court’s directives and strict guidelines, the Uttar Pradesh government has made a significant decision. The decision stipulates that before demolishing any illegal construction, it is mandatory to issue a notice. A notice must be given to the concerned party 15 days before demolishing any illegal constructions. The Uttar Pradesh government’s major decision has been publicly announced.
Chief Secretary Manoj Kumar Singh has issued instructions to implement this decision. Instructions have been sent to all officers deployed in Uttar Pradesh’s districts. All officials in Uttar Pradesh have been directed to immediately comply with these instructions. According to reports, Chief Secretary Manoj Kumar Singh has issued instructions to all District Magistrates, all Development Authorities, and the Urban Development Department in the state. In this, the Chief Secretary referenced the Supreme Court’s decision in the case of Rajendra Kumar Barjatya and others vs. Uttar Pradesh.
Referring to the orders given in the Awas Vikas Parishad and Rajiv Gupta case, instructions have been issued to strictly follow the laws. It was emphasized that before demolishing illegal constructions or removing encroachments, concerned authorities and municipal bodies must adhere to the rules. Those affected must be given a notice 15 days prior to any action. The notice must clearly specify which constructions are illegal. After that, the action will be taken based on law and order.
In the instructions issued by Uttar Pradesh’s Chief Secretary, it is stated that before demolishing illegal constructions, the mandatory notice must also inform the builder about why the construction is being demolished and what part of it violates the rules. It is also required to explain that the construction was not done in accordance with the approved plans as per the construction and development laws.
It is clear that after the Supreme Court’s hammer on the Bulldozer Culture, such a policy has been introduced, offering significant relief to the people of Uttar Pradesh.
